In the present petition, the grievance being raised by the petitioner is with regard to his transfer order which has been issued on 11.03.2024 (Annexure P-6) vide which, the petitioner has been transferred from Jind (ST) to Faridabad (North) (Insp).

Learned counsel for the petitioner submits that the petitioner is retiring on 30.09.2025 and his wife is suffering from cancer, hence, keeping in view the instructions issued by the Government of Haryana dated 07.04.1989, which has been amended vide policy dated 19.11.1998 (Annexure P-7), the petitioner is entitled to continue in service at the present place of posting.

Learned counsel for the petitioner further submits that the petitioner has been transferred from Jind (ST) to Faridabad (North) (Insp) due to General Elections, which are scheduled to be held in the months of April, 2024 and May, 2024 and petitioner has approached the respondents by filing of representation dated 22.02.2024 (Anneuxre P-5) that he be brought back to the parent place of posting after the General Election is over, so that RIYA 2024.04.05 16:11 I attest to the accuracy and integrity of this document

CWP-6126-2024 (O&M) 2024:PHHC:043720 he can take care of his wife who is suffering from cancer, but the said representation is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner.

Learned State counsel submits that in case, the representation dated 22.02.2024 (Annexure P-5) has been received in the office of the concerned authorities and the same is still pending consideration with the authorities concerned, the same will be decided by the competent authority within a period of eight weeks of the receipt of certified copy of this order by passing an appropriate speaking order.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 6.
