Petitioner-Gurbinder Singh has filed this petition under Section 438 read with Section 482 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in Crl. Complaint No.94/2014, dated 16.11.2010, titled as 'Dalip Singh vs. Manmohan Singh and others', pending in the Court of learned Judicial Magistrate Ist Class, Batala wherein the petitioner along with other co-accused has been summoned under Sections 455, 380, 427, 148 and 149 IPC and Section 3 (x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. Notice of motion was issued. Learned State counsel put in appearance on behalf of respondent No.1-State and contested this petition. However, none has appeared on behalf of respondent No.2 despite service to contest this petition.

CRM-M-22333-2016 I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner has been summoned in a complaint case by the trial court.
