Petitioner-Gurbinder Singh has filed this petition under Section 438 read with Section 482 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in Crl. Complaint No.94/2014, dated 16.11.2010, titled as 'Dalip Singh vs. Manmohan Singh and others', pending in the Court of learned Judicial Magistrate Ist Class, Batala wherein the petitioner along with other co-accused has been summoned under Sections 455, 380, 427, 148 and 149 IPC and Section 3 (x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. Notice of motion was issued. Learned State counsel put in appearance on behalf of respondent No.1-State and contested this petition. However, none has appeared on behalf of respondent No.2 despite service to contest this petition.

#      Keeping in view the facts and circumstances of the present case; without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The order dated 08.07.2016, granting interim bail to the petitioner, is made absolute.
