*** H.S. Grewal, J. (Oral) This is a petition for regular bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in FIR No.14 dated 17.02.2023 under Sections 25, 54, 59 of Arms Act, registered at Police Station Sadar Rupnagar, District Rupnagar.

The case of the prosecution is that on 17.02.2023, one pistole of 9MM bore was recovered from the petitioner at the time when he was apprehended. Thereafter, on his disclosure, 02 pistols of .32 bore, 04 pistols of .315 bore and 2 pistols of .30 bore alongwith ammunition were recovered. 3.

Learned counsel for the petitioner contends that the petitioner is in custody for the last 02 years, 02 months and 28 days. He further submits that despite the lapse of this substantial period, the trial has not been commenced yet.

CRM-M-12878-2025 -2custody certificate dated 19.05.2025 vehemently opposes the grant of bail to the petitioner. He further states that the petitioner is involved in one more case under the NDPS Act and is not on bail in that case. He further submits that out of total 10 prosecution witnesses, 05 have been given up and remaining 05 are yet to be examined.

I have heard learned counsel for the parties and gone through the material placed on record.

Keeping in view the alleged recovery of the weapons and ammunition and the fact that the petitioner is involved in one more case under the NDPS Act, no ground is made out to grant the concession of regular bail to the petitioner. Hence, the present petition is dismissed. 5.
