Petitioner has filed instant petition under Section 482 of ,$56$.+-$.
,+ ,0 ! 7 for grant of anticipatory bail in FIR No.43 dated 04.02.2025 under Sections 137 (2), 96 of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Tripuri, District Patiala, Punjab. 2.
As per facts of the case, complainant 'PC' gave his statement that he is driver of E-rickshaw. His elder daughter i.e. victim 'PR' was born on 06.11.2007. She was doing BA 1st year from Punjabi University, Patiala and her examination Centre was Modi College, Patiala. On 01.02.2025 at about 8.30 am, he dropped his daughter at Modi College Patiala as her examination was scheduled to be held till 12.30 pm. After exam she used to return home at her own. However, on 01.02.2025, after examination she did not come home. He sent his brother-in-law Jasvir Singh to the college but
she was not present there. Inquiry was made from the teacher who disclosed that examination was conducted in two phases. His brother-in-law remained in the college till the second shift but did not find the victim. Her mobile phone was also switched off. They tried to locate her whereabouts. They came to know that she had taken away her documents including Aadhar card and cash of Rs.50,000/-. Matter was reported to the police. Earlier his daughter was studying in Civil Lines, Government School and Dilpreet Singh was studying with her. They used to talk to each other on mobile phone. They also went to the house of Dilpreet Singh but his mother Harjinder Kaur told them that his son had left the house on 01.02.2025 and also took away all his documents along with him. Thereafter, Dilpreet Singh did not come home. Therefore, they suspected that Dilpreet Singh along with his mother and two unknown persons had enticed away his daughter to perform her marriage. With these allegations, present case was registered. 3.
Learned counsel for the petitioner stated that in pursuance of interim bail granted vide order dated 05.03.2025, petitioner has already joined the investigation. Allegations levelled against her are without any basis. She is ready to abide by the terms of bail order. 4.
Status report filed today. As per the status report, Dilpreet Singh was arrested on 25.02.2025 and was released on regular bail by learned Additional Sessions Judge, Patiala vide order dated 17.05.2025. Victim was also recovered on the same day and her statement was recorded under Section 164 Cr.P.C. (Annexure R-1). In the later portion, alleged victim stated that before returning home, they had talk with their families and both the family assured to compromise the matter and thereafter, alleged victim
7 returned to her parents. After completion of investigation, challan is already presented on 25.04.2025 and the case is pending for considering on charge. 5.
I have considered the aforesaid factual position. Present petitioner is the mother of main accused. She has already joined the investigation. Alleged victim and main accused had appeared and joined the investigation. As referred above, in the status report, main accused is also granted regular bail and on completion of investigation, challan is also presented in the Court. Considering the aforesaid factual position, no purpose would be served by sending the petitioner behind the bars especially when she has already joined the investigation. Therefore, ad-interim bail already granted vide order dated 05.03.2025 by this Court stands confirmed subject to the conditions envisaged under Section 482 (2) ,$56$. +-$.
