HARINDER SINGH SIDHU, J By this petition, filed under the provisions of Section 438 of the Cr.P.C, the petitioner seeks the concession of anticipatory bail, upon FIR no.125, dated 05.11.2021, having been registered at Police Station Lohian, District Jalandhar, alleging therein the commission of offences punishable under Sections 307,120-B,34 IPC and Sections 25,27 of Arms Act. FIR was lodged on the complaint of one Hardev Singh, who stated that he is resident of village Seechewal, Police Station Lohian, District Jalandhar. He alleged that on 04.11.2021 at about 10.30 p.m, he along with his friends namely Harmeet Singh and Ramandeep Singh was present at village chowk. Suddenly, three persons came there on a Bullet motorcycle. One person, who was riding Splender motorcycle accompanied them.

Bullet motorcycle was being driven by Ashman Singh. There were two persons sitting behind him. The person sitting on the last seat of motorcycle stated that he was close relative of Manjinder Singh. Complainant did not know the name of person sitting between the two. The person who claimed himself to be relative of Manjinder Singh took Ramandeep Singh aside. He started arguing with him and gave him a push as a result of which Ramandeep Singh fell down. Complainant and Harmeet Singh came forward to save Ramandeep Singh. The person who claimed to be relative of Manjinder Singh asked the person sitting ahead of him to open fire at the complainant and his companion. Ashman Singh MANOJ KUMAR 2022.07.

CRM-M-14169 of 2022 #2# raised lalkara. The person sitting in the middle took out a pistol and fired at the complainant. First shot hit on the left flank of Harmeet Singh while the second shot hit on the right thigh of Harmeet Singh. Then the complainant rushed forward to rescue Harmeet Singh. Person holding pistol fired shot at the complainant which hit on his right thigh. On alarm being raised, accused fled away on the motorcycle with their respective weapons. A supplementary statement of the complainant was recorded on 07.11.2021 wherein he disclosed that the petitioner was the person who was sitting between Ashman Singh and relative of Manjinder Singh and it was he who had fired at Harmeet Singh and the complainant. The petitioner has been specifically named by the complainant There is specific allegation against the petitioner that it was he who had fired two shots at Harmeet Singh which hit him on his left leg and right thigh while another shot fired by the petitioner is alleged to have pierced right thigh of the complainant.

Keeping in view the allegations leveled against the petitioner, and considering the gravity of offence, there is no ground to grant anticipatory bail to the petitioner.
