(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner, who is mother of the main accused-Sahil, in case FIR No.38 dated 14.02.2019 under Sections 376(2)(n), 406, 120-B IPC and Sections 3 & 4 of the Dowry Prohibition Act, 1961 registered at Women Police Station Panipat, District Panipat.

Criminal Misc. No. M-11761 of 2019 -2Learned State counsel, on instructions from ASI Ravinder Kumar, does not dispute the aforesaid fact. He further submits that challan in the case was already presented against the petitioner and even charge has also been framed.

I have heard learned counsel for the parties. Admittedly, challan has already been presented against the petitioner and charge has also been framed against her. Therefore, in the light of judgment dated 29.01.2020 passed by Apex Court in the case of Sushila Aggarwal & ors. Vs. State (NCT of Delhi) & anr. SLP (Criminal) Nos.7281-82/2017, the order dated 14.03.2019, whereby the petitioner was admitted on interim bail, is hereby made absolute. Disposed of.
