Seeking issuance of necessary direcƟons to the respondents No.1 and 2 to consider and to decide the parole case of the peƟƟoner pending since 15.01.2024 and grant 10 weeks regular parole to the peƟƟoner under the provisions of SecƟon 3 of The Haryana Good Conduct Prisoner's (Temporary Release) Act, 2022, the peƟƟoner has come up before this Court under ArƟcle 226 of ConsƟtuƟon of India. 2.
Counsel for the peƟƟoner submits that the peƟƟoner had applied for parole on 15.01.2024 for 10 weeks and the authority is siƫng over the maƩer from the last nine months and no acƟon is being taken. 3.
On the other hand, the ground taken by the State counsel was that due to imposiƟon of Model Code of Conduct because of ongoing assembly elecƟon, the decision could not be taken. Now the elecƟons are over and new government has come in place and they will take a decision on the peƟƟon of the peƟƟoner without any delay. 4.
Given the rival submission of both the parƟes, let respondent No.3 take decision on the applicaƟon of the peƟƟoner for grant of parole by 08.11.2024 and refer the maƩer for perusal of respondent No.2 and also communicate the outcome of decision to the peƟƟoner's family without any delay.
