NARESH KUMAR SANGHI, J (Oral) Learned counsel submits that the offences punishable under Sections 120-B and 420, IPC, are triable by learned Judicial Magistrate First Class. Due to inadvertence, without filing the bail application before learned Trial Court, the petitioners had approached the Court of Session and thereafter this Court, therefore, he may be permitted to withdraw the present petition to enable the petitioners to file the application for grant of bail before learned Trial Court at the first instance.

Learned counsel for the State has no objection to the above prayer.
