**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 22 dated 22.2.2012 under Section 489-D IPC, registered at Police Station Dyalpura, District Bathinda.

Learned counsel for the petitioner submits that after having been released on bail pending trial, petitioner had been regularly attending the court proceedings on each and every date fixed before the learned trial court. He further submits that the petitioner sought and was granted exemption from appearance on 29.1.2015. However, petitioner misunderstood that order and did not appear even on the next date of hearing, i.e. 5.2.2015 under the bondafide wrong impression. When the petitioner came to know that he was supposed to appear before the learned trial court on 5.2.2015, he immediately moved an appropriate application for bail, but the same was dismissed by the learned trial court, vide order dated 21.5.2015. CRM-M-21478 of 2015 willing to surrender before the learned trial court and it may be directed to consider the bail application of the petitioner sympathetically and decide the same at an early date. Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is disposed of with a direction to the learned trial court that if the petitioner surrenders before it within a period of one week from today, his bail application shall be considered and decided by passing an appropriate order, strictly in accordance with law and also after taking into consideration all the attending circumstances brought to its notice at the instance of the petitioner.

With the abovesaid observations made and directions issued, instant petition stands disposed of.
