******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.130 dated 17.04.2018 registered for offences punishable under Sections 420 and 406 of Indian Penal Code (for short, "IPC") at Police Station City Barnala, District Barnala.
Heard.
As per allegations in the FIR, petitioner alongwith Raminder Kumar came to the house of complainant-Paramjit Singh and offered to help him in getting franchise under Deen Dayal Upadhaya Gramin Kaushalaya Scheme, as they had good links in Government, on payment of `30 lakhs. Complainant made payment of `5 lakhs to Rajwinder Singh Bhullar (petitioner) and Raminder Kumar on 02.11.2016. He transferred a sum of `2 lakhs to account of Harwinder Kaur (co-accused) and gave two cheques of `5.5 lakhs and `4 lakhs, which were got encashed by Raminder Kumar but franchise was not allotted to complainant. CRM-M-22473 of 2018 -2Learned State counsel submits that the petitioner was arrested on 17.04.2018. The matter is still under investigation as other co-accused are yet to be arrested.
Keeping in view the fact that presentation of challan and then conclusion of trial will take considerably long time but without expressing any opinion on merits of the case, the present petition is allowed. Petitioner-Rajwinder Singh Bhullar is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
