Present petition has been filed under Article 226 of the Constitution of India, inter-alia, for issuance of a writ in the nature of mandamus directing the respondents to consider the candidature of petitioner for selection and appointment against 585 posts of Junior Engineer (Civil), in pursuance of the advertisement No.1 of 2021 dated 05.03.2021 (P-1), on the basis of higher qualification i.e. Bachelor of Engineering (Civil) possessed by him.
In pursuance of the notice of motion, issued by this Court, short reply by way of affidavit of Amrik Singh, Under Secretary, Department of Water Resources, Punjab, dated 01.04.2022 along with annexures R-1 & R-2 filed on behalf of respondent No. 1 is taken on record. Registry to tag the same at appropriate place. Para No.5 of the reply being relevant, is extracted as under: - "5.
That in view of the amendment made by the competent authority, the respondent No. 2 i.e. Punjab Public Service Commission, Patiala, has issued a Corrigendum for the Advertisement No. 1 of 2021 vide SANJAY GUPTA 2022.04.09 16:55 I attest to the accuracy and integrity of this document -1-
CWP No.7850 of 2021 dated 29.04.2021, which was published on the website of the Commission i.e. www.ppsc.gov.in in which the candidates having the higher qualifications are also eligible for applying for this post. The revised academic qualification for the post is now as under: - Should possess three years Diploma in Civil Engineering from a State Technical Education Board from recognized University or Institution OR Higher qualification in the same discipline i.e. Degree in Civil Engineering from recognized University or Institute."
Perusal of the extracted portion of affidavit clearly indicates that relevant clause pertaining to essential qualification contained in the advertisement dated 05.03.2021 has been suitably amended by the respondents at their own level and the candidate(s) having higher qualification in the same discipline i.e. Degree in Civil Engineering from recognized University or institute, like present petitioner, would be eligible for the post(s) in question. In view of the above development, learned counsel, on instructions from the petitioner, acknowledged that his grievance has been redressed and as such he is no longer interested in pursuing the matter.
Disposed off accordingly.
