******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.35 dated 12.03.2015 registered for the offence punishable under Section 22 Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Bhikhiwind, District Tarn Taran.

Petitioner was arrested by ASI Gurvail Singh of Police Station Bhikhiwind, District Tarn Taran on 12.03.2015 and recovery of 100 grams of intoxicating powder (Diphenoxylate) was effected from his possession. The petitioner has sought regular bail in case registered against him without moving application seeking regular bail before the trial Court. CRM-M-22482-2018 -2surrender in Court if the contraband recovered from him is found to be of commercial quantity. On receipt of the report of Chemical Examiner, the contraband was found to be of commercial quantity and the petitioner was taken into custody.

The petitioner is directed to first apply for regular bail before the Judge, Special Court/trial Court before approaching this Court seeking the same relief.
