The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.31 dated 3.4.2014 registered for the offences under Sections 307, 325, 395, 427, 341, 148 and 149 IPC at Police Station Hathur, District Ludhiana.
Notice of motion to Advocate General, Punjab. Mr. P.S. Grewal, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition. Police record is also available.

Cr. Misc. No.M-22431 of 2016 [2] As argued that the petitioner was released on bail by the learned Additional Sessions Judge, Ludhiana, in the case. When the proceedings were pending before the Magistrate, on 2.7.2015, the accused/petitioner absented from the Court proceedings and earlier bailable warrants were issued and then non-bailable warrants were issued and ultimately he was declared proclaimed offender on 19.11.2015. He has again surrendered in the Court on 16.2.2016. Since then, the petitioner is in custody. Keeping in view the facts and circumstances of the present case that the petitioner is in custody for the last about five months for his absence, the disposal of the case will take long time, no useful purpose will be served by keeping the petitioner in custody till the final disposal of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with two sureties each in the like amount to the satisfaction of the trial Court/Duty Magistrate.
