The present petition has been filed by the petitioner for grant of anticipatory bail in case FIR No.29 dated 16.05.2024, registered under Sections 406, 420, 465, 467, 468, 469, 471 and 120-B of IPC, at Police Station Nayagaon, Disgtrict SAS Nagar, Mohali. 2.

ASI Rameshwar Dass is present in the Court and submits that the petitioner had joined investigation on 21.07.2025 and it was on account of some misunderstanding that he could not pass proper instructions to learned DAG, Punjab on the last date of hearing. He has apologized for the mistake Committed by him and has undertaken to be careful in future. 3.

Vide order dated 05.03.2025, passed by this Court, the petitioner was granted interim bail and directed to join investigation. As the petitioner has joined investigation on 21.07.2025 and is not required for custodial interrogation therefore, keeping in view the nature of the allegations, pre-trial incarceration of the petitioner is also not required. As

CRM-M-12302-2025 -2such, a case is made out for allowing the present petition. Accordingly, the petition is allowed and the order dated 05.03.2025, granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
