The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.61 dated 16.6.2017 registered for the offences under Sections 302, 392, 34 and 120-B IPC and Section 25 of the Arms Act at Police Station Bereta, District Mansa. Notice of motion to Advocate General, Punjab. Mr. B.S. Sewak, learned Additional Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Additional Advocate General, Punjab appearing for the respondent-State and have gone through the record.

From the record, I find that as per the allegations in the FIR, Harpal Singh Parmar 2018.05.31 16:09 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-22500 of 2018 [2] one person entered into the car of Satpal brother of the complainant and then fired shot on Satpal and after throwing Satpal on the road he ran away from the spot along with the car. As per the investigation, the present petitioner has been nominated in this case.

Keeping in view the nature and gravity of the offences and the fact that no witness has been examined so far by the prosecution and the case is at preliminary stage and further there is every possibility of tampering with the evidence, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail at this stage. Therefore, finding no merit in this petition, the same is dismissed at this stage.
