**** ANITA CHAUDHRY, J CRM-22954-2018 Application is allowed and Annexure P-3 is taken on record. CRM-M-22505-2018 The petitioner is seeking regular bail in FIR No. 64 dated 7.10.2017 registered at Women Police Station, Panipat under Sections 376, 506 IPC.

Counsel for the petitioner contends that the petitioner is in custody since November 2017 and the statement of the complainant had been recorded but thereafter an application under Section 319 Cr.P.C. was moved which was dismissed. Counsel also submits that the complainant was a widow and there is delay in lodging the FIR. Counsel further submits that the petitioner had performed nikah and they have placed on record copy of the nikahnama as well as the affidavit furnished by the girl who had changed her name to Shabnam.

No. M-22505 of 2018 (O&M) -2Without commenting anything on the merits of the case and considering the factual aspect, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate with the condition that he would not contact the prosecutrix during trial.
