(Oral) Present petition has filed under Section 482 Cr.P.C. for seeking directions to the respondent Nos.1 to 3 to transfer the investigation to some other independent agency and to take appropriate speedy legal action against respondent Nos.4 to 9 in case FIR No.0045 dated 11.04.2016, under Sections 363, 366(A), 506 and 34 IPC (Sections 376(D) IPC and Section 4 of POCSO Act were later on added), registered at Women Police Station Palwal, District Palwal.

CRM-M-22466-2016 -2As per reply, during the course of investigation, statement of prosecutrix Nazida daughter of Aas Mohd. was recorded on 04.06.2016 (Annexure R-1) where she stated that she went with Banti at her own will. Neither any one kidnapped her nor committed rape upon her. Thereafter, the statement of prosecutrix dated 01.09.2016 (Annexure R-3) was got recorded under Section 164 Cr.P.C., where she stated that she went with Abid with her own will and the case registered against him is totally false. On completion of the investigation, on the basis of statements of the prosecutrix, the cancellation report has been made 23.09.2016 (Annexure R-4).
Keeping in view the above-facts, no further action is required to be taken in the present petition and the same stands disposed of accordingly.
