NARESH KUMAR SANGHI, J (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, Bal Krishan Garg, son of Amar Nath, resident of House No. 7, Ram Bagh, Aggar Nagar Enclave, Ludhiana, who has been booked for having committed the offences punishable under Sections 406 and 420, IPC, in a case arising out of FIR No. 170, dated 1.5.2015, registered at Police Station, Focal Point, Ludhiana. Learned counsel contends that in compliance of the interim directions issued by this Court vide order dated 6.7.2015, the petitioner did join the investigation and his custodial interrogation is not required.

CRM-M-21547-2015 Learned counsel for the State on instructions from ASI Surinder Singh of Police Station, Focal Point, Ludhiana, very fairly concedes that the petitioner has joined the investigation and his custodial interrogation is not required.

Learned counsel for the informant though opposed the grant of anticipatory bail to the petitioner, however, he could not substantiate as to why the custody of the petitioner is required. In view of totality of the facts and circumstances of the case, the present petition is allowed. The interim directions issued by this Court vide order dated 6.7.2015 are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
