***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.138 dated 15.03.2017 under Sections 302, 452, 120-B IPC at Police Station Pehowa, District Kurukshetra.

It has been urged before the court that the petitioner is not involved in the crime in any manner. His name does not figure in the FIR. He is, thus, entitled to concession of bail pending trial. Learned State counsel further submits that name of the petitioner figured during investigation. It transpired that the conspiracy to murder Sanjay Kumar was hatched at the residence of the petitioner. According to him, the instant crime is in the nature of supari killing. He, on instructions from ASI Mool Chand, submits that petitioner is involved in 08 other cases. I am of the considered view that the petitioner is not entitled to concession of bail. The trial is at its initial stage. Examination-in-chief of 02 prosecution witnesses is complete. In case, petitioner is released on bail at this stage, it is likely to prejudice the trial. The petition is without any merit. Dismissed.
