On 11.12.2019, the proxy counsel appearing on behalf of learned counsel for the appellant had sought two weeks' time to deposit the amount of Rs 25,000/-, a condition precedent for filing the appeal under the Motor Vehicles Act, 1988. It was categorically stated in the order that in case of non-compliance the appeal would be dismissed for non-prosecution. Thereafter the matter was listed on 03.03.2020 when some more time was sought and the matter was adjourned to 23.07.2020. Thereafter, the matter was adjourned by administrative orders due to the situation created by Pandemic COVID-19. The matter was then taken up on 24.02.2022 and the learned counsel for the appellant was granted last opportunity to deposit the PARKASH CHAND 2022.05.20 13:40 I attest to the accuracy and authenticity of this order/judgment
FAO-No.2097 of 2019 -2amount of Rs.25,000/- as a condition precedent to file the appeal in compliance of the order dated 11.12.2019. Today again the learned counsel for the appellant states that the amount has not been deposited and the matter may be adjourned. There is no ground to further adjourn the matter. The Court is left with no other option but to dismiss the appeal for nonprosecution. Dismissed for non-prosecution.
