R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 228 dated 22.08.2014 for offences under Sections 376, 384 and 506 of Indian Penal Code (IPC), registered at Police Station City Barnala, District Barnala.

Prosecutrix is a 32 years old lady. According to her, the petitioner had been committing sexual intercourse forcibly or under threat of blackmailing for about 2 1⁄2 years. I have heard learned counsel for the petitioner, the State counsel and counsel for the complainant. There is no medical examination of the lady.

Learned counsel for the petitioner submits that no recovery of any article especially the video recording has been made from the petitioner.

Learned State counsel submits that the prosecutrix has since been examined.

CRM-M-2156 of 2015 -2The petitioner is in custody since 22.08.2014 and it will take sometime in conclusion of the trial. In view of the above and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
