The petitioner is seeking regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in FIR No.65 dated 15.09.2024, under Sections 109, 115(2), 351(2), 191(3), 190 of BNS, 2023, registered at Police Station Lohian, District Jalandhar Rural. 2.
Learned counsel for the petitioner submits that the case of the prosecution is that petitioner along with his co-accused have caused injuries to the complainant. It is stated that petitioner has caused injury on the head of the complainant which was dangerous to life. However, at this stage, it is further stated that petitioner has compromised the matter with the complainant. Learned counsel also submits that petitioner has undergone a period of 8 months and 3 days in custody and keeping in view of the above, petitioner be released on regular bail.

Learned State counsel vehemently opposes the prayer for grant of regular bail to the petitioner and filed the custody certificate in Court which is ANIL KUMAR 2025.05.27 10:41 I attest to the accuracy and integrity of this document
CRM-M-12941-2025 taken on record. As per the custody certificate, the petitioner is in custody for 08 months and 3 days.

Mr. Sandeep K. Bansal, Advocate, has appeared on behalf of the complainant and submits that the matter has been compromised between the parties.

I have heard the learned counsel for the parties and perused the record.

In view of the above submission of learned counsel(s), and the fact that petitioner is in custody for 08 months and 3 days as of today and the matter has been compromised between the petitioner and complainant, the continuous detention of the petitioner would not serve the ends of justice. Keeping in view the facts and circumstances of the present case, this Court deems it a fit case to grant the concession of regular bail to the petitioner during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is hereby ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.

However, it is made clear that in case the petitioner misuses the concession of bail, the State would be at liberty to seek cancellation of his bail.
