******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.125 dated 01.05.2017 registered for the offence punishable under Section 61 of Punjab Excise Act, 1914, at Police Station City Kapurthala, District Kapurthala.
Heard.
Learned State counsel submits that recovery of two cartons of countrymade liquor, which were being transported illegally by the petitioner, was effected from his car but he ran away from the spot. Without expressing any opinion on the merits of the case, this petition is allowed and the petitioner is directed to surrender before the police and join investigation within a week. CRM-M-21604-2017 -2required, he shall be released on pre-arrest bail, subject to his furnishing bonds to the satisfaction of Arresting Officer. However, he shall abide by the terms and conditions as envisaged under Section 438(2)(i) to (iv) Cr.P.C. failing which he shall loose the benefit of pre-arrest bail allowed to him.
