Instant petition has been filed under Section 482 Cr.PC for quashing of the order dated 03.02.2023 passed by the Judicial Magistrate 1st Class, Ludhiana, in case FIR No. 149 dated 09.10.2019 under Sections 61/1/14 of the Punjab Excise Act registered at Police Station Basti Jodhewal, District Ludhiana, vide which the petitioner was declared a Proclaimed Offender.

Learned counsel submits that the petitioner was granted bail on 30.11.2019 in the FIR in question but thereafter no summons were delivered or received at his address, therefore, he could not appear before the Court concerned on 03.02.2023 and thus declared a Proclaimed Offender. Learned counsel further submits that the petitioner is ready to appear and join proceedings before the trial Court.

 In view of the submissions made above, the petition is disposed of with direction to the petitioner to appear and surrender before the trial Court on or before 29.07.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioner. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioner fails to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to him.
