(ORAL) This order will dispose of the above noted two petitions i.e. CRM-M-22509 of 2016, filed by Paramjit Kaur and CRM-M-23163 of 2016, filed by Bahadur Singh, for grant of pre-arrest bail. FIR in the present case was registered at the instance of Raj Singh alleging that his father Salwinder Singh was owner of the land which was exchanged vide mutation No.512 dated 21.7.1998 with the land situated at village Saini Majra, Kharar, but in exchange complainant Raj Singh did not get any land from Paramjit Kaur and Rajinder Singh. CRM-M-22509-2016 (O&M) So far as petitioner Bahadur Sngh is concerned, allegation against him is that he was working in the revenue department and he was instrumental in getting the land transferred in favour of his wife Paramjit Kaur.

So far as petitioner Paramit Kaur is concerned, she is alleged to be beneficiary of the act of Bahadur Singh. Rajinder Singh is brother in law of accused Bahadur Singh and held a Special Power of Attorney of Jagtar Singh who was attorney holder of father of complainant Raj Singh. The act of tampering of the documents is pertaining to an incident of 12.7.1998. FIR has been registered after a period of 18 years. It has been informed that till date there has not been any civil litigation pertaining to any wrong documents having been prepared. Pursuant to the interim orders, petitioners Paramjit Kaur and Bahadur Singh have joined investigation. It does not appear to be a case of custodial interrogation of both the petitioners as the culpability of the petitioners is to be determined on the basis of documents only.

Both the petitions are allowed. It is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the conditions that they will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
