The petitioner is seeking anticipatory bail in FIR No. 200 dated 09.06.2015, registered under Sections 306 IPC, Police Station Jodhewal, District Ludhiana.

The counsel for the petitioner contends that the main allegations in the FIR were against the mother in law and the husband used to leave the girl in her parent's house everyday and the girl was suffering from Scleroderma. The counsel refers to the reports of December, 2014. The counsel urges that the life of such a patient is not more than 9 years and her treatment had started somewhere in 2006 and the petitioner was present in the hospital.

The State counsel states that the death was on account of poisoning and not on account of the disease and as per his instructions the Gurpreet Singh Bhatia 2016.08.20 13:35 I attest to the accuracy and authenticity of this document High Court Chandigarh

Crl. Misc. No.M- 22548 of 2016 (O&M) girl was taken to Shivam Hospital first but was referred to Civil Hospital and was declared brought dead at CMC Hospital and there was no heart beat and she was bleeding.

The petitioner was asked to place on record any document to show the treatment taken in 2015. No record post December, 2014 has been placed on record. The death is on account of poison. The family had levelled allegations. The death is not on account of Scleroderma. It is the petitioner alone who would know that what happened at that moment as the parents had alleged that condition of the daughter was not good. She was vomiting blood when she was left at the parents house. Considering the circumstances, no case for anticipatory bail is made out. The petition is dismissed.
