*** Learned State counsel on instructions from ASI Sudesh states that the prosecution has since concluded its evidence and statement of accused has been recorded under Section 313 Cr.P.C. and in that way the trial is likely to be concluded in near future. He has placed on file the custody certificate of the petitioner.

Hearing such statement of learned State counsel, learned counsel for the petitioner states that he be permitted to withdraw present the petition, however, he has requested that trial Court be directed to conclude the trial expeditiously. Permission is granted. The petition is dismissed as withdrawn. The trial Court is directed to conclude the trial expeditiously by giving short adjournments preferably within a period of six months from the date of receipt of copy of this order in the Court. The prosecution is directed to ensure the presence of the witnesses summoned for a particular date and should avoid seeking adjournments without any justifiable reason.
