Through this Civil Writ Petition under Articles 226/227 of the Constitution of India prayer has been made for issuance of writ, order or direction in the nature of certiorari for quashing order of the Presiding Officer, Central Government Industrial Tribunal-cum-Labour Court-II, Delhi, dated 16.09.2019 (Annexure P-8).

Learned counsel inter alia contends that the Tribunal erred in setting aside well-reasoned order of the Commissioner, ignoring provisions of Section 2-F of the Employees Provident Fund and Miscellaneous Provisions Act, 1952. In case, Commissioner did not take any steps to verify documents and antecedents of the building contractor engaged by respondent No.1, the Tribunal ought to have remanded the case for fresh RAVINDER SINGH 2020.06.23 17:36 I attest to the accuracy and integrity of this document

Having given thoughtful consideration to the submissions made by learned counsel for the petitioner, this Court finds the instant Writ Petition completely frivolous inasmuch as previously also the case was remanded. This is the third round of litigation for the same cause. Dismissed.
