 is praying for issuance of a writ in the nature of certiorari for quashing the order dated 13.02.2026 (Annexure P-13) passed by respondent No.2 whereby, the petitioner has been transferred from Government Primary School Moti Nagar Block Mangat-2, District Ludhiana to Government Primary School Hussainpura Block Mangat-1, District Ludhiana. 2.

Learned counsel for the petitioner submits that the transfer order dated 13.02.2026 (Annexure P-13) has been passed on the basis of direction given by the Punjab State Commission for Scheduled Caste, Chandigarh (hereinafter to be referred as 'Commission') (respondent No.5). Learned counsel submits that Commission cannot give direction for transfer of the petitioner as it can only make recommendation. It is also the case of learned counsel for the DIWAKER GULATI 2026.03.10 14:17 I attest to the accuracy and integrity of this document -1-



 petitioner that the abovesaid order dated 13.02.2026 (Annexure P-13) is by way of punishment.

Learned State counsel submits that perusal of transfer order dated 13.02.2026 (Annexure P-13) would show that the transfer has been effected on the basis of complaint and enquiry is still pending. As such, for the purpose of fair enquiry, the petitioner has been transferred.

Learned State counsel, on instructions from Mr. Sushil Nath, Assistant Director, office of DPI (EE), submits that the case of the petitioner will be reconsidered, in accordance with law, for transfer back to Government Primary School Moti Nagar Block Mangat-2, District Ludhiana, in case the petitioner is exonerated in the enquiry which is pending.

In view of the statement given by learned State counsel, learned counsel for the petitioner submits that he does not want to press the present writ petition, at this stage.
