This is petitioner's 8th attempt to get bail during the pedency of a trial in a criminal case arising from FIR No.38, dated 07.08.2018, registrered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 25/54/49 of the Arms Act, 1959 (added later on) at Police Station Special Task Force, Phase IV, Mohali, District STF Wing, Punjab.

On amendment of the charge, the prosecution has started recording the evidence of the witnesses afresh. Though, as per the allegations, the petitioner was found in conscious possession of 30 gram heroin which does not fall in commercial category, however, from the perusal of order passed on 18.12.2019, it is evident that the petitioner has already been convicted under the NDPS Act, 1985 in three cases. Apart from this case, there is yet another case pending against the petitioner under NDPS Act, 1985.

Keeping in view the aforesaid facts, even if the petitioner has suffered incarceration for a period of nearly 4 years and 10 months, this Court is not inclined to grant concession of bail. 4.
Dismissed.
