***** Anupinder Singh Grewal, J. (Oral) This is a petition under Section 439 Cr.P.C. for seeking interim bail to the petitioner to enable him to attend the marriage of his sister. The petitioner is under trial in FIR No. 43, dated 11.02.2015, under Sections 302, 148, 149, 120-B, 216 IPC and Section 25 of the Arms Act, registered at Police Station Narwana Sadar, Jind.

Learned counsel for the petitioner contends that the petitioner is the only brother of his sister whose marriage is scheduled for 18.06.2017 and his presence is required for conducting the rituals in the marriage. Learned State counsel opposes the grant of interim bail. He, however, upon instructions from ASI Dilbagh Singh, has confirmed the marriage of the sister of the petitioner on 18.06.2017 and also the fact that the petitioner is the only brother.

I am of the considered view that the petitioner being the only brother of his sister should be allowed to attend her marriage but in police custody.

Consequently, the Superintendent of Police, Jind, is directed that the petitioner be taken in police custody so as to reach the venue at Narnaud (Hisar) at 6.00 p.m. on 18.06.2017 and immediately after the marriage is over, he will be taken back to the District Jail, Jind on the morning of 19.06.2017.

The petition stand disposed of accordingly.
