Prayer in the present petition, filed under Section 439 of the Code of Criminal Procedure, is for grant of regular bail to the petitioner in case FIR No.166 dated 09.07.2022 (Annexure P-1), registered under Sections 15, 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short `NDPS Act') (Section 27 of the NDPS Act, added later on), at Police Station City Muktsar, District Sri Muktsar Sahib.

fellow employees, was going towards Goniana Road, Abohar Road etc. in a private car for patrolling and checking of suspicious persons. It is stated that when the police party reached near Cremation ground, Goniana Road, Sri Muktsar Sahib, a secret informer gave information that Bullet son of Bhola Singh, Baba Ikatar Singh, Nikka son of Gora, Kasu son of Bhinda, Deepu son of Kakku Kabadia, Kamaljeet Kaur wife of Jas Karan Singh, Rajinder Kumar son of Jagan Nath, Jimmy (petitioner) and Geja, are indulged in the sale of narcotics/drugs and in case, a raid is conducted now, then they can be apprehended and heavy quantity of heroin/intoxicant tablets, poppy husk can be recovered from them. 4.
Finding the said information reliable, a ruqa was prepared and sent to the Police Station and FIR was registered against accused persons. -

petitioner has been in custody since 01.02.2023; the trial is likely to take some time to conclude and no useful purpose would be served by keeping him behind the bars. Learned counsel further submits that the petitioner is not involved in any other case under the NDPS Act and he is ready and willing to abide by all the conditions as may be imposed by this Court or by the trial Court; accordingly, prayer for grant of regular bail is made. 4* :
