JUSTICE SANDEEP MOUDGIL Present: Mr. Sumit Kalyan, Advocate, for Mr. Bhanu Partap Singh, Advocate, for the petitioner Mr. Rajiv Verma, DAG, Punjab --- SANDEEP MOUDGIL, J (ORAL) This petition has been filed under Section 482 Cr.P.C. seeking directions to the trial Court and the investigating agency to expedite the trial in case FIR No.152 dated 19.10.2018, under Sections 124-A, 153-A, 154-B, 120-B IPC, 1864, registered at Police Station Sultanwind, District Police Commissionerate Amritsar (Annexure P-1), which was subsequently registered as RC-19/2020/NIA/DLI dated 5.4.2020, Police Station NIA, New Delhi (Annexure P-2), pending in the Court of Special Judge, CBI, SAS Nagar.

Having perused the record, the petition do not want interference from this Court since on perusal of the zimni orders from 3.1.2022 to the last date, out of these 32 dates, its only on five occasions that no prosecution evidence could be produced but on other 27 occasions, Ashwani Kumar 2024.05.23 19:58 I attest to the accuracy and integrity of this document
CRM-M No.13322 of 2024 evidence has been recorded of different witnesses wherein total number of 105 prosecution witnesses are to be examined and examination of 26 have been completed in a span of little more than two years. It is also evident from the record, which is not disputed by learned counsel for the petitioner as well, that the gap between the dates given by the concerned Special Judge, NIA, is not more than 20-25 days and in that eventuality this Court do not deem it appropriate to issue unwarranted direction to trial Court proceedings which are going on satisfactorily. 3.
The petition in the aforesaid terms being mis-placed and misdirected having no iota of any grudge which also could not be made out of the submissions of learned counsel for the petitioner to accept that the trial is going on for the last more than two years, the proceedings are progressing satisfactorily. Hence, the petition is devoid of merit and stands dismissed.

Record received by this court shall be sent back through special messenger positively by tomorrow.
