The petitioner has come up before this Court under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 seeking anticipatory bail in FIR No.226 dated 02.09.2024 under Sections 13(3) of HGS Act and GS Act, 2015 and 61 of BNS (Section 8/13(3) HGS & GS Act & 61(2) of BNS mentioned in impugned order Annexure P-2) registered at Police Station Nagina, District Nuh.

In compliance of order dated 07.03.2025, learned State counsel has already filed status report by way of an affidavit of Ajaib Singh, Deputy Superintendent of Police, Firojpur Jhirka on behalf of respondent - State. As per the status report, two more cases under Section 174-A are registered against the petitioner vide FIR No.103 dated 09.06.2023 and FIR No.104 dated 09.06.2023. Thereafter, he was arrested and did not surrender before the Court.

I have heard the submissions made by the learned counsel for the parties, and have gone through the file.

Keeping in view the conduct of the petitioner and his antecedents, custodial interrogation of the petitioner is required and the petitioner is not entitled for concession of anticipatory bail. Accordingly, present petition stands dismissed.

Anything stated hereinabove shall have no effect on the merits of the case as it is only for the purpose of deciding the present petition. The trial Court shall decide the case on the basis of material available before it. (H.S.GREWAL) JUDGE 09.04.2025.
