29.07.2024 Sidhwan Bet, District 110, 117(2), 190, 191 and Ludhiana (Rural) 351 BNS section 110 BNS was deleted but Sections 109, 115(2), 118(1), 140(3) and 324(2) BNS have been added The petitioner incarcerated in the above captioned FIR, has come up before this Court seeking anticipatory bail under Section 482 of BNSS, 2023.

Complainant's counsel as well as State counsel have raised a preliminary objection about wrong declaration in paragraph 13 of the petition in which the petitioner has mentioned that he is not involved in any other FIR, whereas there has been 07 more FIRs against him. List has been supplied to the petitioner's counsel. Petitioner's counsel submits that the said mistake is bona fide not intentional.

Faced with the above, petitioner's counsel wishes to withdraw the instant petition with liberty to file a fresh petition. 3.
Given above, the present petition is disposed off with liberty aforesaid. It is clarified that withdrawal of the present petition shall not bar the petitioner from filing a fresh petition. Pending applications, if any, stand disposed of.
