Hearing conducted through Video Conferencing. Petitioners were appointed as Junior Engineers by way of direct recruitment in the Department of Public Health, Haryana and joined their duties in April 2017. They were confirmed in April 2019. They possess the qualification of Bachelor of Engineering i.e. a Degree Holders. Their grievance is that no separate seniority is being maintained in the rank of Junior Engineers, concededly governed by Haryana Public Works Department, Public Health Branch, Junior Engineers (Group C) Service Rules,1986 (for short 1986 Rules), who are Degree Holders for consideration for promotion to the post of Sub Divisional Engineer against a separate promotional quota of 14% for Degree Holders, as per Punjab Service of Engineers, Class-II, PWD (Public Health Branch), Rules 1966 (for short 1966 Rules).

They claim that they had acquired the minimum eligibility of experience of two years and vacancies in their quota were available in the year 2019, however, the same are not being filled up so as to RAJINDER PARSHAD JOSHI 2020.06.

C.W.P. No. 7943/2020 -2qualification of Degree of Bachelor of Engineering. Consequently, proceedings of DPC dated 20.3.2020 is sought to be quashed. Further prayer is also for carving out a separate seniority of Junior Engineers with Degree Holders.

At the time of hearing, realizing that pleadings in the light of fresh documents to be produced, have to be changed, learned counsel for the petitioners prays for permission to withdraw the writ petition with liberty to petitioners to file a fresh one with fresh documents. Dismissed as withdrawn with liberty as prayed for. ( JASWANT SINGH ) JUDGE June 12,2020.
