CORAM:

HON'BLE MR. JUSTICE M.M.S. BEDI PRESENT Ms.Ravinder Kaur Manaise, Advocate, for the petitioner in both petitions.

Mr.C.S.Brar, DAG., Punjab.

Ms.Sharmila Sharma, Advocate, for the complainant.

M.M.S. BEDI, J (ORAL) This order will dispose of the above noted two petitions for the grant of pre-arrest bail i.e., CRM-M-21806-2014 titled Preeti Vs State of Punjab and CRM-M-22970-2014 titled Beero Vs State of Punjab, in a case registered at the instance of Gurdeep Singh Bedi alleging that the petitioners had been working as a domestic maids at the house of the complainant and Preeti had RAJ KUMAR ARORA 2015.02.20 10:34 I attest to the accuracy and integrity of this document

CRM-M-21806-2014 (O&M) stolen gold jewellery and left the work.

The petitioners were granted the concession of interim bail. They have joined investigation. With the assistance of the State counsel, I have gone through the police file and the statement of Richa. I have gone through the police file and perused the status of the investigation. Though the FIR was registered on 19.12.2013, till date even the site plan from where the alleged articles were stolen has not been prepared. The statements of the witnesses recorded during the course of investigation did not prima facie indict the petitioners as thieves having stolen ornaments. Petitioner Preeti is minor whereas other petitioner is also a lady. They having joined investigation can be granted the concession of prearrest bail as on the basis of the investigation conducted till date it is only a suspicion against the petitioners without there being any material indicating the involvement of the petitioners in the act of theft.

Both the petitions are allowed. It is ordered that in case of arrest of the petitioners they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join investigation as and when required. (M.M.S. BEDI) February 19, 2015.
