The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.201 dated 19.6.2016 registered for the offences under Sections 306 and 34 IPC at Police Station Civil Lines, District Sonepat.
I have heard learned counsel for the petitioner and have gone through the record.
As per the FIR, Sumit Goel (since deceased) was given threat through the present petitioner to marry with one Anu, otherwise he will kill him. Ashok Kumar is stated to be earlier lover of Anu and he stated that he cannot see Anu sad and can do anything for her. Sumit Goel has consumed poisonous substance. The present petitioner is named in the FIR. Specific allegations have been levelled in the suicide note, copy of which is Annexure-P.2, that the present petitioner was making pressure upon Sumit HARPAL SINGH PARMAR 2016.07.18 12:16 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-22709 of 2015 [2] Goel and threatening to kill him (deceased).
Keeping in view the above facts, nature and gravity of the offence, I find that the petitioner is required for custodial interrogation. Therefore, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail.
Hence, finding no merit in this petition, the same is dismissed. July 11, 2016.
