M.M.S. BEDI, J. (ORAL) Petitioner in the capacity as Executive Officer of Municipal Council, Dasuya, had allegedly made excess payments to the Contractors who had not done work as per the prescribed specifications. The Contractor have been granted the concession of pre-arrest bail on depositing the amount received in excess without prejudice to their rights to claim their due from the Municipal Committee. The petitioner has joined investigation. In view of said circumstances, the petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction of the arresting officer subject to the conditions that he will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
