******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioners in case FIR No.181 dated 24.12.2017 registered for offences punishable under Sections 382/454 of Indian Penal Code (for short, "IPC") at Police Station CDivision, Amritsar City, District Amritsar. (Offences punishable under Sections 392/355/411/120-B IPC were added later on). Heard.

Admittedly, main accused in this case, namely, Navjot Kaur @ Jyoti and Gobind Shergil have already been allowed bail vide orders dated 09.02.2018 and 23.04.2018 passed in CRM-M-3105-2018 and CRM-M12240-2018, respectively. Petitioners were arrested in this case on 28.12.2017 and are in custody since then. After completion of investigation challan has already been presented in Court.

Keeping in view the fact that co-accused, namely, Navjot Kaur Jitender Kumar 2018.05.31 17:05 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH

CRM-M-22806 of 2018 -2- @ Jyoti and Gobind Shergil have been allowed bail and that conclusion of trial will take considerably long time but without expressing any opinion on merits of the case and, the present petition is allowed. Petitioners, namely, Sarabjit Singh @ Sabba and Surjit Singh @ Sonu are ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) Petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of their absence on any date of hearing, the benefit of bail allowed to petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bonds and surety bonds and proceed to procure their presence in accordance with law. In that eventuality petitioners shall have to apply for bail afresh. (c) They shall not leave the country without the previous permission of the Court.
