NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 215 dated 08.08.2022 (Annexure P-1) registered under Sections 328, 376(2)(n) and 506 IPC and Section 66 e of the Information Technology (Amendment) Act, 2008 at Police Station Civil Lines, District Rohtak. Learned counsel for the State has filed custody certificate dated 22.09.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year and 09 days. After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition, at this stage.
