(ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No. 40 dated 16.03.2017, under Sections 366/ 376/ 506/ 120-B IPC, registered at Police Station Jandiala, Tehsil and District Amritsar. This Court was pleased to pass the following order on 14.06.2017 :- "Learned counsel for the petitioner submits that the prosecutrix is more than 22 years of age and even as per the FIR itself, had been in a physical relationship with the petitioner for about 5 to 6 months.

Notice of motion returnable for 06.07.2017.

In the meanwhile, upon his joining investigation, in case he is sought to be arrested, he would be released on bail, till the next date of hearing, on his furnishing adequate bail and surety bonds to the satisfaction of the arresting officer/Ilaqa Magistrate. If the arresting officer does not join the petitioner in investigation, he would appear before the learned Ilaqa Magistrate immediately, who would then summon the arresting officer and direct him to join him in the investigation."

Learned counsel for the petitioner submits that the petitioner has joined the investigation.

Mrs. Anju Arora, learned Addl. A.G., Punjab, confirms the factum of joining investigation by the petitioner herein. I have heard learned counsel for the parties. Keeping in view the fact that the petitioner has joined the investigation, the petition is allowed and interim order dated 14.06.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
