Dated Police Station Sections 15.10.2021 Chatiwind, District 379-B, 395, 201 IPC and Sections 25, Amritsar, Punjab 27, 54/59 of Arms Act Seeking quashing of proclamation order dated 06.11.2023 (Annexure P-2), the petitioner has come up before this court under Section 528 BNSS 2023. 2.

The accused could not be served through the ordinary process, including summons, bailable warrants, and even non-bailable warrants. The concerned court finally proceeded against the petitioner under section 82 of CrPC and declared the petitioner a proclaimed offender vide order dated 06.11.2023.

The petitioner seeks to quash by stating in paragraph 6 that he did not know his being arraigned as an accused. Ld. counsel submitted that Coordinate Bench of this court had granted interim bail to the petitioner vide order dated 10.03.2025 after considering the absence of knowledge.

The stand taken by the petitioner was justiciable for the purpose of bail; however, the same stand is not at all justiciable to seek quashing of the proclamation order and subsequent proceedings. The stand taken by the accused qua absence of knowledge needs evidence with an opportunity to the State to test the credibility of such evidence. Thus, the petitioner fails to make out a case.
