**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.160 dated 24.07.2019 registered under Section 61/1/14 of Excise Act at Police Station Nathana, District Bathinda.
50 litres of lahan is allegedly recovered on the basis of secret information.
Notice of motion was issued on 18.03.2020 on the premise that despite the FIR having been registered on the basis of secret information, the police has not complied with mandatory requirement of Section 100(4) Cr.P.C. CRM-M No. 11379 of 2020 -2Learned State counsel on instructions from ASI Surjit Singh submits that the petitioner has joined the investigation on 05.06.2020, challan has been submitted on 19.06.2021 and now the case is fixed for 28.09.2021 for framing of charges. With filing of challan, presence of the petitioner is not required for further investigation in the case. In view of above, order dated 18.03.2020 is hereby made absolute.
However, the petitioner shall keep on appearing before the trial Court regularly.
Disposed of.
