The petitioner claims that he had signed the cheque on behalf of the partnership firm, whereas partnership firm has not been made a party.

I have heard counsel for the petitioner and gone through the order passed by the trial court and the revisional court and I am of the opinion that it will not be appropriate to express any opinion regarding the culpability of the petitioner in the capacity as signatory of the cheque and quash the proceedings merely on the ground that the partnership firm has not been made a party.

The petition is dismissed with liberty to the petitioner to raise the said defence plea before the trial court, to be considered at an opportune time by the trial court.
