HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.53 dated 16.03.2018 under Section 22 of NDPS Act registered at P.S Division No.5, Jalandhar.

As per allegations, the petitioner has been found in possession of 110 grams of powder containing salt of Alprazolam. It is the case of prosecution that the petitioner was initially arrested on 16.03.2018. As the report of FSL was not received, he was released on bail on 31.05.2018. During the period, the petitioner was on interim bail, he was involved in another case registered under NDPS Act on the basis of disclosure statement of the accused in that case, who was found in possession of 01 gram of heroin. As the petitioner had not surrendered after receipt of report of FSL, his bail bonds were cancelled. Thereafter, petitioner was arrested on 31.07.2020 and has been in custody since then. It is stated that the trial is not making any headway because of Covid-19.

Without commenting anything on the merits of the case and also bearing in mind the custody period of the petitioner coupled with the fact that the trial may take long time to conclude, in my opinion, no useful MANOJ KUMAR 2021.08.06 12:59 I attest to the accuracy and integrity of this document
