The petitioner has been in custody since 29.9.2014 for having been found in possession of 810 tablets of alprazolam, weighing 120 mgs. Each. Total weight of 810 tablets could be 97.2 grams, whereas any quantity beyond 100 grams could be a commercial quantity as per the statute. Even otherwise, the report of Chemical Examiner has not been received. The petitioner was also found in possession of approximately 1000 tablets of Tramzee plus and Tormadex containing Tramadol salt. The said salt does not appear to be a narcotic salt, as per the provisions of NDPS Act.

In view of the above circumstances, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that he will not commit the similar offence, of which he is accused of, during pendency of the trial.
