RSA No.2882 of 2002(O&M) [2] appellant who is stated to have passed away on 23.05.2003. For the reasons mentioned in the application and the arguments addressed, the person mentioned in para 2 of the application, is impleaded as legal representative of the appellant, for the purpose of this appeal and subject to just exceptions.

Amended memo of parties is taken on record.

Application is disposed of.

CM No.5538-C of 2019 in RSA No.2882 of 2002 Prayer in the application is for withdrawal of this appeal, which stands admitted vide order dated 11.11.2002.

Learned counsel for the applicant/appellant submits that the original appellant-Harbhajan Singh has since passed away and applicant-Amarbir Singh is the only legal heir of appellant - Harbhajan Singh. It is submitted that no dispute is pending regarding the estate of Harbhajan Singh and the applicant no longer wishes to continue with this appeal. It is further submitted that a copy of this application has been duly conveyed to the respondent through courier. At request of learned counsel for the applicant/appellant, the appeal is taken up for hearing today itself.

Keeping in view the stand of the applicant as above and his categoric assertion, application is allowed and appeal is accordingly dismissed as withdrawn.
