Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.23 dated 03.02.2015 under Sections 328, 379 and 411 IPC, registered at Police Station GRP, Jalandhar. Notice of motion On asking of the Court, Mr.K.D.Sachdeva, Addl. Advocate General, Punjab, who is present in the Court, accepts notice on behalf of the respondent-State and contests the petition.
Police record is also available.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the occurrence is of 20.01.2014 and the FIR was got registered on 03.02.2015 i.e. after about one year of the VINEET GULATI 2016.07.16 12:34 I attest to the accuracy and authenticity of this document Chandigarh occurrence. The prosecution case is that the complainant was travelling in
CRM No.M-22851 of 2016 -2the train and the petitioner was also travelling in that train and the petitioner administered some poisonous substance to the complainant. The allegation against the petitioner is that he took away three mobile phones and ATM etc. and withdrew the amount from the account of the complainant. The present petitioner is in custody since 03.02.2016. He is not named in the FIR. The petitioner is no more required for interrogation or investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody.
Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bonds in the sum of `35,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
