(Oral) Petitioners by way of present petition is seeking quashing of order dated 24.09.2015 (Annexure P-2), passed by the learned Magistrate, Jalandhar through which the charges under Section 498-A, 323 and 506 IPC have been framed, charge sheet dated 24.09.2015 (Annexure P-3) and order dated 18.05.2016 (Annexure P-4), vide which the revision petition filed by them has been dismissed by the learned Additional Sessions Judge, Jalandhar.
After hearing the learned counsel for the petitioners, going through the record, the present petition is disposed of by observing that the proceedings in the trial Court shall go on, however, the personal presence of the petitioners are exempted before the trial Court, subject to the following conditions:- (i) petitioners shall be represented through counsel; (ii) shall not delay/stall the trial proceedings; (iii) shall not dispute his/their identity as an accused: (iv) shall have no objection if the prosecution evidence is recorded in his/their absence but in the presence of his/their counsel; (v) shall appear before the trial Court as and when required by the trial Court; and (vi) any other condition which the learned trial Court may impose.
